Second Trial Court: "Although the Crime Nature Is Not Good, Considered Offender's Remorse"
[Asia Economy Reporter Heo Midam] A teenager who was prosecuted for abusing his one-month-old son by putting him in a toilet bowl because his live-in girlfriend refused to have sexual relations was sentenced to a suspended prison term in the appellate court.
The Incheon District Court Criminal Appeals Division 3 (Presiding Judge Han Daegyun) overturned the original sentence of 5 years imprisonment for A (19), who was charged with special intimidation and child abuse under the Child Welfare Act, and sentenced him to 3 years imprisonment with a 5-year suspension on the 1st.
However, as in the first trial, A was ordered to complete a 40-hour child abuse treatment program and was restricted from working at child-related institutions for 5 years.
The appellate court stated, "The defendant assaulted and abused the victims he was supposed to protect," and "Considering the circumstances of the crime, the nature of the offense is not good."
However, the court explained the sentencing reason, saying, "The defendant admitted all the crimes and showed remorse, and C, who reached a settlement during the appeal, did not want punishment," and "Considering that the defendant pledged to raise B sincerely in the future."
A was charged with grabbing the neck of his then one-month-old son B and placing him on a kitchen sink in a villa in Michuhol-gu, Incheon, around 4 a.m. on December 15 last year, and threatening his live-in girlfriend C (14) with a weapon.
A threatened C while putting B into the toilet bowl and reportedly slapped C’s cheek 15 times, saying, "If you make a sound, the baby will die inside the toilet." It was investigated that A committed the crime in a fit of anger because C refused to have sexual relations despite agreeing to it.
In addition, A frequently assaulted C from February to December of the same year, grabbing her hair, slapping her cheeks, or kicking her belly, and threatened her by putting a weapon to the belly of C, who was seven months pregnant, in the summer of last year, claiming she made a careless remark to acquaintances.
