[Asia Economy Reporter Ra Young-cheol] There is a growing call for urgent review of the criteria for public disclosure of sex offenders' personal information, as the current standard applies the timing of the crime rather than the severity or nature of the offense. This has resulted in hundreds of electronic monitoring bracelet wearers being excluded from public disclosure.


According to data submitted by the Ministry of Justice to Oh Young-hwan, a member of the National Assembly's Public Administration and Security Committee from the Democratic Party representing Uijeongbu City A district, 563 electronic monitoring bracelet wearers are excluded from public disclosure of their personal information.


By crime type, rape and sexual assault accounted for the largest number at 276, followed by robbery and rape (255), rape and murder (16), and forced molestation (16).


The reason their personal information is not disclosed is that although the 'Sexual Violence Punishment Act' was amended in June 2013 to require public disclosure and notification of sex offenders convicted before the amendment, the retroactive period was limited to three years, excluding convictions finalized before that period from retroactive application.


The 'Sexual Violence Punishment Act' was enacted and implemented in April 2011, introducing the system for registering and publicly disclosing sex offenders' personal information.


Assemblyman Oh stated, "Excessive retroactive application infringes on human rights, so the retroactive period is limited to three years, resulting in only partial disclosure. It is necessary to reconsider the criteria for public disclosure based on the severity of the crime rather than the timing."
