[Asia Economy Reporter Jang Hyowon] It has become possible to hold general meetings of reconstruction associations through electronic voting when it is difficult for members to attend in person due to COVID-19 or other reasons.


According to the Ministry of Land, Infrastructure and Transport on the 22nd, the amendment to the "Urban and Residential Environment Improvement Act," which includes this content, passed the National Assembly's Legislation and Judiciary Committee on the same day.


The bill states that when it is difficult for members to attend the general meeting due to disasters, voting rights can be exercised through electronic voting.


Disasters refer to those defined in Article 3, Paragraph 1 of the "Framework Act on the Management of Disasters and Safety." This includes natural disasters such as typhoons and floods, as well as social disasters such as fires, traffic accidents, and infectious diseases.


However, electronic voting is limited to cases where a disaster occurs and the local government recognizes that it is difficult for members to attend in person.


Under the current law, resolutions at general meetings require the attendance of a majority of members and the approval of a majority of those present, with at least 10% of members attending in person. For founding general meetings or the establishment of management disposition plans, at least 20% attendance is required.


Additionally, the amendment stipulates that if executives of maintenance project associations such as reconstruction and redevelopment, or professional association managers, are prosecuted for violating laws other than the Urban and Residential Environment Improvement Act, the court shall issue separate rulings on violations of the Urban and Residential Environment Improvement Act.


Meanwhile, the original bill included a provision requiring reconstruction association members in speculative overheated districts to reside for two years to receive pre-sale rights, but this was removed during the National Assembly discussions.
