[Asia Economy Reporter Kim Choyoung] A Chinese national resident who spat on and caused fractures to two security guards for not allowing a friend's vehicle to pass through the apartment entrance has appealed the first trial verdict.
According to the Bucheon Branch of the Incheon District Court on the 12th, A (37), a Chinese national and CEO of a travel agency, who was arrested and indicted on charges of injury, assault, obstruction of business, and property damage, submitted an appeal to the court on the 9th after receiving a sentence of one year in prison with a two-year probation in the first trial.
A submitted the appeal through a lawyer and did not submit a separate statement of reasons for the appeal.
Earlier, on the 2nd, Judge Jung Chanwoo of the Criminal Division 1 at the Bucheon Branch of the Incheon District Court sentenced A to one year in prison with a two-year probation and issued a probation order at the sentencing hearing.
The court stated, "The defendant, being heavily intoxicated, assaulted the security guard and a fellow security guard and damaged the security office, thereby obstructing security duties. At the time of the crime and afterward, the defendant made disrespectful remarks such as 'I will give you as much money as you want, so get up,' and 'Who are you? Do you need money too?' This case was reported to the media through reports from residents, causing public outrage, and the nature of the crime is serious."
It added, "More than 4,900 residents submitted petitions requesting severe punishment for the defendant," but also explained the sentencing background by saying, "Considering that the defendant confessed and showed remorse, reached a settlement with the victims, and that the victims do not want punishment, a prison sentence will not be imposed."
A was indicted for assaulting security guards B (60) and C (58) at around 11:40 p.m. on January 11 at the back gate of an apartment in Janggi-dong, Gimpo-si, Gyeonggi Province. He is also charged with obstructing business by hitting the security office window with a chair.
At the time, A, who was intoxicated, assaulted B multiple times in the abdomen with his fist after the security guards prevented his friend's vehicle from entering, and also hit C's face who tried to stop him.
As a result of the assault, B suffered rib injuries and C sustained serious injuries including a collapsed nasal bone.
Meanwhile, two police officers who responded to the report but did not arrest A as a suspect on the spot and instead took him to a nearby hotel received a warning without further punishment.
