The Pyeongtaek Branch of Suwon District Court, 1st Criminal Division (Chief Judge Kim Seyong) announced on the 7th that A, who was indicted on charges of murder, was sentenced to 3 years in prison with a 5-year probation. She was also ordered to complete 200 hours of community service.
The court stated, "This case is recognized as one involving indirect intent. Although there was no intent to kill, considering the circumstances and motives leading to the crime, the death of the husband could have been foreseen."
It continued, "However, it appears that the crime was committed in a moment of uncontrollable rage rather than due to any particular grudge, and there is also a request for leniency from the bereaved family," adding, "Indirect intent is acknowledged, but it does not appear to be definite intent," explaining the sentencing rationale.
According to the prosecution, A was indicted for driving a sports utility vehicle (SUV) into a reservoir in Pyeongtaek at 9:56 p.m. on February 11, 2018, causing the drowning death of her husband who was riding with her.
The incident began when the husband arrived 30 minutes late at the agreed meeting place. At the time, A had gone out after receiving a message from her husband asking her to pick him up because he had been drinking, but the husband arrived 30 minutes late, leading to a quarrel between the couple.
During this process, the husband suspected A of infidelity, and unable to endure the accusations, wife A made the extreme choice of momentarily driving the car into the reservoir.
