Prosecutors: "Difficult to Consider as Trespassing... Strict Response to New Digital Sex Crimes"

The Busan District Prosecutors' Office Eastern Branch announced on the 29th that A (41) was arrested and indicted, and B (29) was indicted without detention on charges of violating the Special Act on the Punishment of Sexual Violence Crimes, etc. (filming using a camera, etc.).
They are accused of flying a drone near the window of a high-rise apartment in Busan from 12:08 a.m. to 3 a.m. last month to secretly film residents.
According to the prosecution, A controlled the drone, and B identified the filming targets.
They also filmed residents engaging in sexual activities while naked.
Their crime was uncovered due to the drone crashing.
The prosecution stated that there was no evidence that they distributed the videos to third parties or used them for commercial purposes.
They also confirmed that no other illegal filming was found besides the footage taken that day.
The prosecution said, "Filming inside from outside the apartment window was difficult to consider as 'physical intrusion' under the crime of trespassing," and added, "Flying a drone at night without special flight approval is subject to a fine under the Aviation Safety Act, and the Busan Regional Aviation Administration will be notified."
However, they stated, "We will strictly respond to new types of digital sex crimes that are becoming increasingly threatening with the development of information technology."
