[Asia Economy Reporter Seongpil Cho] A man in his 50s who wielded a weapon against his wife who came home late was sentenced to a suspended prison term. The man avoided a heavy sentence after being acquitted of attempted murder among the charges against him.


According to the legal community on the 21st, the Seoul High Court Criminal Division 6 (Presiding Judge Seokjun Oh) dismissed the prosecution's appeal in the appellate trial of Kang Mo (55), who was charged with attempted murder, and sentenced him to 2 years in prison with a 4-year suspension, the same as the first trial. The court found insufficient evidence to prove that Kang intended to kill the victim and therefore did not recognize the attempted murder charge. Only the charge of aggravated assault was upheld. However, the court stated that regarding the aggravated assault charge, "Since the prosecution did not specify separate grounds for appeal, it is not possible to judge whether the sentencing was inappropriate."


Kang was tried on charges of wielding a weapon against his wife A (52) when she came home early in the morning the day after going hiking in January. A sustained a wound about 10 cm long on her rib area from the weapon Kang wielded. Although Kang and A legally divorced in 2005, they continued to live together afterward, and investigations revealed that they often quarreled due to A's late return home.
