[Asia Economy Reporter Lim Juhyung] The prosecution has demanded heavy sentences for two male students who were tried for the gang rape of a female middle school student attending the same school.
At the sentencing hearing held on the 19th at the Incheon District Court Criminal Division 13 (Presiding Judge Ko Eunseol), the prosecution requested 10 years of long-term imprisonment and 7 years of short-term imprisonment each for A (15) and B (15), who were indicted in custody on charges of violating the Special Act on the Punishment of Sexual Violence Crimes (rape and injury). They also requested orders to complete a sexual violence treatment program and a 10-year employment ban at institutions related to children and adolescents.
The prosecution stated the reason for the demand, saying, "Although the defendants are middle school students and young, they fully understood how serious the crime was," and "Even considering their youth, strict punishment is necessary."
They were indicted in custody on charges of forcibly giving alcohol to female student C from the same school around 3 a.m. on December 23 last year at a gym in an apartment in Incheon, dragging her to the 28th-floor stairs of the apartment, raping her, and injuring her while attempting another rape.
Police investigations confirmed that A raped C, while B attempted rape but failed. Additional investigation by the prosecution found deleted records on A’s mobile phone at the time of the crime showing that he took nude photos of the victim.
The apartment’s closed-circuit television (CCTV) captured the two dragging the unconscious victim.

The case sparked public outrage after being brought to light through a Blue House petition by C’s mother demanding severe punishment for the perpetrators.
In a post titled "I accuse the minors who gave my daughter alcohol and gang-raped her" posted on the national petition board on March 29, C’s mother stated, "The perpetrators gave my daughter alcohol in their apartment, dragged my unconscious daughter on the ground while giggling, and took her to the top floor stairs of the 28th floor of the apartment where there was no CCTV," adding, "During the process, they hit my daughter’s face, spat on her, and raped her in order."
She continued, "They mocked my daughter’s brother by sending a thumbs-up emoticon, and one of the perpetrators repeatedly called my daughter and her brother," and "Because of this, my daughter cried for hours and even attempted self-harm that day."
She also said, "Our family had to sell our house quickly and move, and my daughter transferred schools," urging strict punishment for the perpetrators by saying, "They must be investigated in custody to prevent ongoing harm to the sexual violence victim." The petition received 400,474 signatures, more than twice the 200,000 required for an official response.
