Later, while two members of the group briefly left the house, A sexually assaulted the intoxicated victim B, who had collapsed, and took nude photos with his mobile phone, sending them to others.

The court stated, "A took advantage of the victim's inability to resist to commit sexual assault and even photographed and transmitted the images, showing an attitude of treating the victim as a sexual object. However, considering that he was an 18-year-old youth at the time of the incident, mentally not fully mature, committed the crime impulsively, and reached an agreement with the victim, the sentence is determined comprehensively."
