Defendant: "Agreed to sexual intercourse during conversation"
Court: "Shows no remorse at all"
[Asia Economy Reporter Kim Bong-ju] A current doctor was legally detained for taking a woman who was sitting drunk on the street to a lodging facility and sexually assaulting her.
On the 25th, the Criminal Division 11 of Daejeon District Court (Chief Judge Kim Yong-chan) sentenced A (28), who was indicted on charges of sexual assault, to two years in prison.
According to the legal community, Dr. A (28) saw a woman in her 20s who was heavily intoxicated and sitting on the street unable to control her body while returning home in the early hours last summer. After briefly talking with her, he took her by taxi to a nearby hotel.
A was indicted without detention on charges of sexually assaulting the victim in the hotel room.
A denied the charges, claiming, "I approached her out of concern and talked, and we only consented to sexual intercourse."
The court found it difficult to consider that the sexual intercourse was consensual, given witness statements that "the woman was unable to control her body" and the fact that the two moved to the hotel within about 10 minutes of talking.
The court said, "It cannot be considered a normal decision-making process that the intoxicated victim, who did not even know the defendant's personal information, consented to the relationship," adding, "Nevertheless, the defendant used the victim's condition as an excuse to commit the crime after exchanging a few words."
The court also judged that the claim "I approached because I was worried since my profession is a doctor" was an incomprehensible statement.
Furthermore, the court explained the sentencing reason, saying, "He targeted an unfamiliar, defenseless woman as a victim," and "A doctor, who should protect human life, sexually assaulted a heavily intoxicated woman and shows no remorse at all."
Additionally, the court stated, "Many defendants seem to hold a distorted prejudice that 'heavily intoxicated female victims are implicitly likely to consent to sexual intercourse,'" and "Because of this wrong misconception, many people are appealing their grievances and disputing."
