According to the legal community on the 7th, Judge Park Jin-hwan of the Seoul Central District Court Criminal Division 1 sentenced Coach A, who was indicted for trespassing, to a fine of 3 million won.
The court ruled A guilty based on a Supreme Court precedent stating, "Even if a person enters a residence with the consent of the spouse for the purpose of adultery during the husband's temporary absence, the husband's control and management relationship over the residence still continues."
It also stated, "The defendant knew that B had a legal spouse but trespassed into the residence against the implicit will of the husband, the victim, disturbing the peace," and "Considering the mental shock suffered by the victim, it is appropriate to impose strict legal responsibility."
However, the court explained, "The sentence was determined comprehensively considering that B and her spouse recently divorced through voluntary mediation, changing the circumstances from the time of the crime."
A was indicted for trespassing into B's residence without the permission of B's husband C, who was living separately, while maintaining an extramarital relationship with B, the mother of two students A was coaching.
Meanwhile, A was also referred to the prosecution on charges of assaulting B's 10-year-old son under the pretext of sports education.
