[Asia Economy Reporter Seongpil Jo] Lee Joong-geun, chairman of Booyoung Group, requested release in defiance of the appellate court's decision to revoke his bail, but the request was denied.


According to the legal community on the 28th, the Seoul High Court Criminal Division 20 (Presiding Judges Kang Young-soo, Jung Moon-kyung, Lee Jae-chan) dismissed Lee's quasi-appeal filed against the prosecution's detention enforcement order the day before.


The court stated, "If the execution is suspended simply because the bail revocation decision was made by the High Court, it would result in a situation where bail revocation cannot be enforced in the appellate court even if there are grounds. This could undermine the legislative intent of the Criminal Procedure Act, which stipulates reasons for bail revocation such as the defendant's flight, evidence destruction, or harm to the victim."


Furthermore, it added, "Whether to recognize the suspension effect of execution for immediate appeals is a legislative policy issue to be determined by considering the necessity and potential harm. It is not something that inevitably follows from the nature of immediate appeals."


Lee was sentenced to 2 years and 6 months in prison and fined 10 million won in the appellate trial last January on charges including embezzlement and breach of trust involving hundreds of millions of won. While on bail and undergoing trial without detention, Lee was taken into custody in court after his bail was revoked.
