On the 13th, the United Future Party cited the opinion of Kim Yeon-ho, head of the Legal Support Group, saying, "Candidate Cha's remarks and the display of banners are closely related to party affairs, which are important matters concerning the general election support for candidates nationwide."
According to Article 32 of the United Future Party's party constitution, the Supreme Council has the authority to ▲convene the National Committee and the Standing National Committee ▲request the convening of the General Assembly of Members ▲consult on the appointment of party officials ▲approve the nomination of National Assembly candidates ▲appoint and dismiss party officials ▲approve party budgets and conduct accounting audits ▲deliberate and decide on matters referred by the National Committee, etc. ▲handle other major matters related to party operations ▲deliberate and decide on other major party affairs.
Also, according to Article 31 of the party constitution, the Supreme Council is the deliberative and decision-making body for overall party affairs. The party leader and Supreme Council members are the highest decision-making body of the party, appointed only through nomination by the party convention, the highest organ of the party organization. Therefore, the Supreme Council is the highest decision-making body regarding party affairs.
Attorney Kim said, "The matter of expulsion of candidate Cha falls under party affairs. Since there is no definition of what constitutes party affairs in the party constitution, the Supreme Council has jurisdiction over all party matters as party affairs," adding, "In particular, this is not simply a matter related only to the personal compliance of whether candidate Cha is expelled."
He judged, "The judgment on candidate Cha's remarks and actions, which have a decisive impact on the success or failure of general election support for candidates nationwide, is directly related to party affairs, and the Supreme Council can decide on disciplinary action pursuant to Article 32, Paragraph 1, Items 8 and 9 of the party constitution."
