Due to 'Tada' Legal Dispute... Drivers File Criminal Complaints Against Lee Jae-woong and Park Jae-wook


[Asia Economy Reporter Buaeri] Amid deepening internal conflicts following the suspension of Tada Basic service, Tada drivers have announced legal disputes including criminal complaints and civil lawsuits against the parent company Socar and Tada operator VCNC.


According to the Tada Emergency Response Committee on the 8th, the drivers plan to file a criminal complaint against former Socar CEO Lee Jae-woong and current CEO Park Jae-wook at the Seoul Central District Prosecutors' Office on the morning of the 9th. The charges include violations of the Dispatch Act and the Labor Standards Act.


With Tada announcing that it will provide Basic service only until the 10th, drivers facing the risk of losing their jobs have launched the Emergency Response Committee for survival, with about 270 members registered so far.


Those contracted as dispatched workers are prohibited from being dispatched to transportation businesses, and the main accusation is that Tada has dispatched them. Tada drivers are divided into dispatched workers employed by dispatch agencies and freelancers (individual business operators).


Article 2 of the Enforcement Decree of the Dispatch Act includes "driving work under the Passenger Transport Service Act" among the prohibited tasks for dispatched workers. This means that workers dispatched through manpower agencies should not be directly commanded or supervised to operate passenger transport services.


The Emergency Response Committee also plans to file complaints for violations of the Labor Standards Act and other charges regarding the suspicion that Tada conducted "illegal labor supervision" over freelance drivers. Committee Chairman Kim Tae-hwan stated, "Tada claims it did not conduct illegal labor supervision, but through the driver application (app), they penalize drivers who leave the waiting area and announced that they would not assign rides if the customer rating falls below 4.5."


Alongside the criminal complaints, the Tada Emergency Response Committee is gathering drivers' support for a civil lawsuit to recognize their status as workers. They believe that collective action by drivers will increase the chances of winning the class-action lawsuit. The committee plans to file the complaint on the 27th.
