The Ulsan District Court Criminal Appeal Division 1 (Chief Judge Lee Woo-cheol) announced on the 5th that it overturned the original sentence of 6 months imprisonment and sentenced a 40-year-old man, Mr. A, who was tried on charges of public obscenity, to 5 months imprisonment in the appeal trial.
Doctor A was indicted for entering a university in Ulsan last July and committing an obscene act by lowering his pants while looking at a female student in her 20s walking in front of a building, and was sentenced to 6 months imprisonment in the first trial.
At the time, Mr. A fled when the female student screamed but was caught by her boyfriend, and denied the charges saying, "The woman misunderstood."
The first trial court sentenced him to 6 months imprisonment considering that Mr. A had already been punished three times with fines and suspended sentences for similar crimes and committed the crime again, and that he did not admit to the crime.
Mr. A appealed, claiming the sentence was too heavy.
The second trial court stated the reason for the reduced sentence, saying, "He admitted to the crime in the appeal trial, and the victim also wrote a settlement agreement stating that she does not want to punish the defendant, so it is necessary to reconsider the sentence imposed in the original trial."
