Yoon Sukyeol's Team Submits Opinion to Court Stating Special Prosecutor's Arrest Warrant Lacks Procedural Legitimacy

On June 25, former President Yoon Sukyeol's legal team submitted a written opinion to the court regarding the arrest warrant request by Special Prosecutor Cho Eunseok's team investigating insurrection, stating that "the arrest warrant constitutes an illegal act lacking procedural legitimacy."

In a press release that morning, the legal representatives for former President Yoon stated, "Former President Yoon has not received a single summons from the special prosecutor to date," and added, "He has not been provided with any information about the location of the special prosecutor's office, the interrogation room, or the prosecutor in charge."


They continued, "It is incomprehensible for the special prosecutor to request an arrest warrant for a former president while omitting all such basic procedures. This action seriously infringes on the suspect's right to defense and human rights."


The legal team further stated, "The special prosecutor and the police are clearly separate investigative bodies. It is legally unsound for the special prosecutor to request an arrest warrant by invoking a police-stage appearance request. This constitutes an illegal act lacking procedural legitimacy," and added, "The legal representatives have submitted the relevant opinion to the court, sufficiently explaining the seriousness of the matter and the procedural illegality, and we expect the court to make a careful and wise decision."


Previously, on June 24, Special Prosecutor Cho Eunseok's team, which is investigating the insurrection and treason case related to the 12·3 Martial Law, requested an arrest warrant for former President Yoon from the Seoul Central District Court on charges including obstruction of special official duties.


The court is expected to decide whether to issue the arrest warrant for former President Yoon during the day.
