Ministry of Justice Shows Different Stance from Prosecution on Separation of Investigative and Prosecutorial Powers

The National Planning Committee, which is serving as the transition team for the Lee Jaemyung administration, announced that it will prioritize organizational restructuring measures mentioned in presidential campaign pledges, such as the separation of functions within the Ministry of Economy and Finance, the separation of investigative and prosecutorial powers within the prosecution, and the establishment of a Ministry of Climate and Energy.
Jo Seungrae, spokesperson for the National Planning Committee, held a briefing at the Changseongdong Annex of the Seoul Government Complex on the afternoon of the 23rd and stated, "We are compiling and organizing President Lee Jaemyung's campaign pledges and the organizational restructuring needs of each division that emerged during the presidential election process." He explained that these restructuring measures are currently being discussed within the organizational restructuring task force (TF) established under the committee. Jo added, "We will separately organize the organizational restructuring demands arising from changes in the times, as raised by civil society, the media, experts, or government ministries."
The Democratic Party is considering a plan to separate the budget formulation function from the Ministry of Economy and Finance and divide it into a Planning and Budget Office and a Ministry of Finance and Economy. Regarding the prosecution, the so-called "completion of prosecution reform," which involves separating investigative and prosecutorial powers, was one of President Lee's pledges. Accordingly, there is also discussion about downsizing and separating the prosecution into a "Prosecution Office" responsible only for indictments or a "Public Prosecution Office" responsible for maintaining public prosecutions.
Regarding the separation of investigative and prosecutorial powers within the prosecution, spokesperson Jo referred to the Ministry of Justice's work report held on the 20th and stated, "There was a difference in temperature (in views) with the prosecution." Unlike the prosecution, whose work report was interrupted midway, the Ministry of Justice is interpreted to have shown a positive response. He added, "According to the division heads, there was a sense that there was a difference in temperature with the prosecution regarding the separation of investigative and prosecutorial powers."
During the work report at that time, it is known that members of the Political and Administrative Division of the National Planning Committee emphasized the need to consider the de-prosecution of the Ministry of Justice, the separation of investigative and prosecutorial powers within the prosecution, and the role the ministry should play as a department for the protection of human rights.
Spokesperson Jo went on to say, "This week, we will begin drafting how to classify national tasks by division within the National Planning Division," and added, "We will conduct prior discussions with the ruling party and each standing committee, and for pledges common to both parties, we will also consult with the opposition party."
At the full committee meeting of the National Planning Committee held in the morning, Ha Jeongwoo, Senior Secretary for AI Future Planning at the Presidential Office, delivered a lecture. Spokesperson Jo said, "We shared global trends regarding artificial intelligence (AI)," and added, "There was discussion about the need for a comprehensive strategy that covers all aspects of the ecosystem, including related social overhead capital (SOC), the industrial ecosystem, talent development, and global governance, in order to build an AI ecosystem."
Meanwhile, the National Planning Committee will receive work reports from the Financial Supervisory Service, the Bank of Korea, the Korea Development Bank, and the Export-Import Bank of Korea from June 24 to June 26. Starting with the Financial Supervisory Service on the afternoon of the 24th, work reports will be held with the Bank of Korea on the 26th, and with the Korea Development Bank, Export-Import Bank of Korea, Korea Inclusive Finance Agency, Credit Counseling and Recovery Service, and Korea Credit Guarantee Fund on the 27th.
