Changwon Jinhae District Takes Proactive Steps to Resolve Repurchase Agreement Complaints Through Active Administration

The Jinhae District of Changwon Special City in South Gyeongsang Province is taking proactive administrative measures regarding real estate properties with repurchase agreements in order to protect citizens' property rights and resolve long-standing unresolved civil complaints.

The repurchase agreements were established during the former Jinhae City era, granting a registered right to exercise a repurchase option within a certain period when disposing of real estate for public development and other purposes. However, even though the repurchase period had already expired?surpassing the statutory five-year limit?the repurchase agreement registration had not been canceled, resulting in restrictions for property owners in exercising their property rights, such as selling or mortgaging the property.


In particular, after Jinhae City was merged into Changwon City, the main department responsible for related matters became unclear, leading to continued inquiries and civil complaints regarding the cancellation of repurchase agreements. This measure is being evaluated as a proactive step to structurally resolve these issues and alleviate inconvenience for citizens.


◆ Project Overview

This proactive administrative measure targets 64 land parcels (a total of 65 registrations) in the Taebaek-dong and Idong areas of Jinhae District. Due to the merger, the repurchase right holder changed from Jinhae City to Changwon City, and property owners were in urgent need of cooperation from the current repurchase right holder to cancel the registration.


The cancellation of registration will be processed collectively by Changwon City through a request registration method, in close cooperation with the Jinhae Registry Office. The city administration will directly proceed with the cancellation process by confirming the actual expiration of the repurchase right, even without issuing a separate document for the termination of the repurchase agreement. The total budget required is 195,000 won, with the registration application fee of 3,000 won per case covered by the city budget.


◆ The Key to Problem Solving: 'Proactive Interpretation and Execution'

In the past, the main department was not clearly defined, resulting in repeated inquiries to the civil complaints department and unclear responsibility due to the dispersion of duties. This initiative is significant as it demonstrates the local government's independent approach to clearing expired rights and proactively deleting remaining registration records after the repurchase right has expired, thereby enhancing administrative trust.


Through collaboration with the Jinhae Registry Office (headed by Lee Hyungki), Changwon City will directly carry out the request registration process even if individual property owners do not apply, which is expected to significantly reduce inconvenience for landowners.


Jinhae District Mayor Jung Hyunseop stated, "This cancellation of repurchase agreements is part of our citizen-centered proactive administration," adding, "We will continue to identify similar cases to create changes that citizens can truly feel."
