Prior Record for Drunk Driving in 2022
A man in his 20s who was caught driving under the influence without a license and presented an acquaintance's ID was sentenced to prison and detained in court.
On the 19th, Judge Kim Eun-hye of the Incheon District Court Criminal Division 17 announced that A (28), who was indicted without detention on charges including drunk driving and unlicensed driving under the Road Traffic Act, was sentenced to 8 months in prison and detained in court.
A was charged with driving a passenger car under the influence of alcohol on a road in Michuhol-gu, Incheon, at 6:18 a.m. on January 30 of last year.
According to the police investigation, A was confirmed to have driven under the influence over a 5 km section from Yeonsu-gu to Michuhol-gu. At the time of apprehension, his blood alcohol concentration was 0.143%, which is the level for license cancellation, and he was unlicensed.
When the police officer asked to see his ID, A presented an acquaintance's driver's license and even wrote the acquaintance's name in the police report. He had a prior record of being sentenced to 1 year and 4 months in prison with a 2-year probation in 2022 for charges including drunk driving.
Judge Kim stated, "Considering the nature and method of the defendant's crime, the quality of the offense is not good," and judged, "The defendant committed the crime again during the probation period for drunk driving, which increases the blameworthiness."
However, the judge explained the sentencing by saying, "Immediately after the crime, he admitted his wrongdoing on his own, and considering that the defendant's family showed determination to prevent recidivism."
