Yoon Sang-hyun of People Power Party Proposes HCICU Special Prosecutor Act
"'Impeachment Trial for President Yoon Violates Due Process and Should Be Dismissed'"
Yoon Sang-hyun, a member of the People Power Party who proposed the Special Prosecutor Act for the High-ranking Officials' Crime Investigation Unit (HCICU), has called for cooperation from the Democratic Party of Korea on the matter.
On the 16th, Yoon held a press conference at the National Assembly in Yeouido and raised his voice, saying, "The Democratic Party must actively cooperate with the HCICU Special Prosecutor Act."
Yoon stated, "The HCICU concealed the fact that the communication and search and seizure warrants requested at the Seoul Central District Court, which specified President Yoon as a suspect, were dismissed, and instead requested arrest and search warrants at the Western District Court for President Yoon," adding, "There are also suspicions that some investigation records were deliberately omitted when requesting the prosecution to indict President Yoon on January 26."
He said, "'There was no request for a warrant for President Yoon at the Central District Court to the National Assembly,' and deliberately sent a false written response," adding, "This means the HCICU engaged in so-called 'warrant shopping' by reapplying for warrants at courts where specific judges are stationed."
He continued, "The Democratic Party has stated that it was not involved at all in the HCICU's illegal investigation and arrest process," and said, "If so, they should clarify their claims through this HCICU Special Prosecutor Act."
Regarding Yoon's proposal of the HCICU Special Prosecutor Act, Cho Seung-rae, the senior spokesperson for the Democratic Party, responded, "I don't know because I haven't looked at the bill in detail," but added, "I would like to say that the court has acknowledged all actions of the joint investigation headquarters (JIH) formed by the HCICU during the investigation, arrest, and warrant requests."
On the same day, Yoon also argued that President Yoon's impeachment trial should be dismissed. He cited the recent decision by the Central District Court to cancel President Yoon's detention, saying, "There were serious procedural defects throughout the impeachment trial process." He said, "The court stated, 'It is appropriate to cancel the detention order to ensure procedural clarity and to resolve doubts regarding the legality of the investigation process,'" adding, "In other words, this declares the principle of due process."
He added, "Since this is an illegal impeachment rife with violations of the principle of due process and unfairness, the impeachment trial against President Yoon should naturally be dismissed."
