10 Months Imprisonment with 2 Years Probation
Court: "Excessive Actions Beyond Disciplinary Scope"
A man in his 40s who emotionally and physically abused his teenage adopted daughter under the pretext of disciplining her was sentenced to a suspended prison term.
On the 22nd, Judge Kang Myeong-jung of the Criminal Division 1 at the Yeongwol Branch of Chuncheon District Court sentenced A (female, 44), who was indicted without detention on charges of violating the Child Welfare Act (child abuse), to 10 months in prison with a 2-year suspension.
A was charged with physically abusing her adopted daughter B (19), whom she adopted in 2005, three times and emotionally abusing her three times at their home and at B’s grandmother’s house in Yeongwol from 2012 to January 2022.
In mid-January 2022, at her home in Wonju, A emotionally abused B, who was 17 at the time, during a phone call by expressing anger over B frequently staying at her boyfriend’s house, saying, "If you live like this, you won’t make it. Let’s prepare the paperwork; I will give you up for adoption."
In the fall of 2015, when B, then 10 years old, was upset while talking about an incident with her friends, A suddenly became angry and said, "You should have acted like this in that situation. Are you brainless?"
A was also accused of assaulting B. In early June 2021, at her grandmother’s house in Yeongwol County, B, having learned that she was adopted, said something to the effect of, "If that’s the case, why did you bring me here?" Angered by this, A slapped B’s cheek.
The court stated, "The crime is serious as the defendant physically and emotionally abused her adopted daughter during the process of disciplining her," and ruled, "The defendant’s actions exceeded the bounds of proper discipline and were excessive." However, the court also explained the sentencing by considering "the overall circumstances that these acts were carried out with the intention of discipline."
