The Anti-Corruption and Civil Rights Commission announced on the 23rd that it is desirable to maintain the lease contract for public rental housing in cases where there are special circumstances involving only registering a move-in without actually residing in the public rental housing.

Mr. A has been residing in a public rental housing with a sale conversion option operated by the Korea Land and Housing Corporation since around November 2015. His child, Mr. B, separated the household after marriage and was living separately, but due to being stalked, only registered a move-in on paper at Mr. A’s public rental housing last year.


The Korea Land and Housing Corporation notified in January this year that it would be difficult to renew the public rental housing lease contract after confirming that Mr. B, a household member of Mr. A according to the resident registration, owned a house.


According to the investigation by the Anti-Corruption and Civil Rights Commission, Mr. B separated the household from Mr. A after marriage, and based on the payment of management fees, taxi usage, and parcel receipt records, it was confirmed that he is living with his spouse. It appears that Mr. B registered the move-in only due to stalking without the intention to actually merge households, and it was found that Mr. A restored his qualification as a non-homeowner household member by transferring the resident registration from the public rental housing.


The Commission expressed its opinion to the corporation to cancel the eviction order of Mr. A from the public rental housing, which was issued on the grounds that his child owned a house without the intention to actually reside, and to allow continued residence.


Kim Taegyu, Vice Chairman of the Commission, said, “Considering the purpose and intent of the public rental housing system to promote housing stability for socially vulnerable groups, it is necessary to carefully examine whether there are unavoidable reasons even if a tenant’s household member owns another house.”
