Submission of Objection Response to Court on the Morning of the 13th
Deliberating Whether to Appeal to Seoul High Court as Deadline Approaches
[Asia Economy Reporter Yoo Byung-don] Former People Power Party leader Lee Jun-seok has filed an objection to the court's dismissal of the injunction request to suspend the effectiveness and execution of duties of the 'Jung Jin-seok Emergency Response Committee.'
On the morning of the 13th, Lee's legal representatives submitted a written response to the objection against the dismissal of the 3rd to 5th injunction requests to the Civil Division 51 of the Seoul Southern District Court (Chief Judge Hwang Jeong-su), according to their statement.
In the response, they stated, "The provision that the Emergency Response Committee must be formed when four or more elected supreme council members resign is clearly unconstitutional and invalid as it violates Article 8 of the Constitution on party democracy and Article 29 of the Political Parties Act regarding the consensus of party members," adding, "Vacancy means 'a vacant position,' which is not a non-retroactive effect but clearly corresponds to a retroactive effect."
They continued, "The Constitution stipulates that when a vacancy (due to resignation, death, or impeachment by the Constitutional Court) occurs, a successor must be elected within 60 days," and argued, "According to the dismissal decision, the vacancy could continue for several months, implying that the successor could be elected within 90, 120, or 150 days instead of within 60 days, which would cause extreme confusion."
Previously, the Civil Division 51 of the Seoul Southern District Court dismissed all injunction requests filed by Lee, including the suspension of the effectiveness of the 'Emergency Situation' party constitution amendment by the National Committee (3rd), suspension of Chairman Jung's execution of duties (4th), and suspension of duties of six emergency response committee members (5th).
Meanwhile, Lee's side is reportedly considering whether to appeal the dismissal decision to the Seoul High Court. The deadline for appeal is today.
