Kim Byungki: "All Chief Prosecutors Who Defied Orders Must Be Dismissed... Will Abolish Prosecutors' Disciplinary Act to Allow Dismissal"

Kim Byungki: "Immediate Dismissal of All Defiant Chief Prosecutors"
"Abolish Prosecutors' Privilege Act, Enforce Dismissal and Disciplinary Measures"
Strict Punishment Through Special Prosecutor if Illegal Acts Are Confirmed

Kim Byungki, floor leader of the Democratic Party of Korea, has called for the dismissal of a chief prosecutor who protested the decision to forgo an appeal in the Daejang-dong trial. Kim also announced his intention to abolish the Prosecutors’ Disciplinary Act to allow for the dismissal of prosecutors.

At the Supreme Council meeting held at the National Assembly on November 12, Kim stated, “We will hold political prosecutors fully accountable for their rebellion,” and added, “The Democratic Party will mobilize all legal and administrative means to crush the rebellion of political prosecutors.”

He continued, “I strongly urge Justice Minister Jeong Sungho to immediately dismiss all chief prosecutors who defied orders and to promptly initiate disciplinary procedures to prevent them from resigning voluntarily.” He further emphasized, “The same applies to branch chiefs and regular prosecutors who participated in the defiance. The Democratic Party will also take immediate action.”

Kim also pledged to abolish the Prosecutors’ Disciplinary Act, which makes it difficult to dismiss prosecutors. He stated, “Unlike other public officials, prosecutors cannot be dismissed for insubordination under the Prosecutors’ Disciplinary Act, which has effectively become a privilege for prosecutors. We will abolish this law so that prosecutors who defy orders can be dismissed or removed from office under the State Public Officials Act.” He added, “What kind of public officials discuss internal organizational issues outside the decision-making process and leak them externally by abusing the work network for media play? How many public officials in our country have survived after doing such things?” He went on to say, “If there is an organization where such public officials face no discrimination or punishment, or even thrive, then that organization should be abolished and rebuilt from scratch.”

Kim also announced plans to launch a parliamentary investigation and a special prosecutor’s probe. He said, “The Democratic Party will immediately initiate a parliamentary investigation to uncover the truth. If any illegal acts are confirmed through this investigation, we will ensure strict punishment through a special prosecutor.” He continued, “We will thoroughly reveal the truth behind all manipulative investigations and indictments carried out by political prosecutors, as well as the reality of their rebellion disguised as defiance. Every step of the process will be conducted transparently and fairly so that the public can see and hear the truth for themselves.”
