Gyeonggi Province Governor Kim Dong-yeon expressed strong regret on the 7th regarding the court's decision to cancel the detention of President Yoon Seok-yeol.
In a post on his social media (SNS) on the same day, Governor Kim said, "I strongly regret the decision to cancel the detention of the leader of the rebellion," adding, "It is an absurd and unacceptable matter."
He continued, "Isn't it overlooking the seriousness of the crime of rebellion while emphasizing procedural strictness?"
Earlier, the 25th Criminal Division of the Seoul Central District Court (Presiding Judge Ji Gwi-yeon) accepted President Yoon's request to cancel his detention, arguing that the detention was unjust.
The court explained that since President Yoon was indicted after the detention period had expired, the detention period should be calculated based on actual time rather than calendar days.
Regarding whether the period during which investigation-related documents were with the court for the purpose of reviewing the legality of the arrest should be excluded from the detention period, the court judged that it is difficult to consider such a period as excluded from the detention period.
It added that, in light of the constitutional and criminal procedure law principles of personal liberty and the presumption of non-detention during investigation, it is appropriate to interpret these strictly in favor of the suspect.
