'10,000 Won Alimony' First Lawsuit Already Filed
As the number of citizens who suffered mental damage from the 'December 3 Emergency Martial Law Declaration Incident' filed a lawsuit seeking damages against President Yoon, the number of participants in this lawsuit exceeded 10,000 within just four days of recruitment.
On the 13th, the 'Preparation Group for the Lawsuit Claiming Compensation for Yoon Seok-yeol's Treasonous Acts' announced that the number of citizen plaintiffs expressing their intention to participate in the lawsuit demanding compensation from President Yoon reached 10,060. According to Yonhap News on the same day, by region, Gyeonggi had the highest number of participants with 3,014, followed by ▲Seoul 2,752 ▲Incheon 633 ▲Gwangju 574 ▲Busan 461 ▲Gyeongnam 355 ▲Jeonnam 316 ▲Daegu 310 ▲Jeonbuk 267 ▲Chungnam 254 ▲Daejeon 248 ▲Gyeongbuk 240 ▲Chungbuk 225 ▲Gangwon 213 ▲Ulsan 133 ▲Jeju 95 ▲Sejong 75.
Among them, 191 individuals are known to be either National Assembly staff or aides to members of the National Assembly who blocked the entry of martial law troops into the National Assembly during the emergency martial law incident. The lawsuit preparation group has been recruiting plaintiffs to participate in the damages lawsuit since the 10th. The proposal for this lawsuit was made by Attorney Lee Geum-gyu, who served as the representative for the National Assembly side during the impeachment of former President Park Geun-hye, and Attorney Kim Jeong-ho, who represents victims in civil and criminal lawsuits related to former President Chun Doo-hwan's memoirs. Initially, the lawsuit preparation group planned to recruit plaintiffs without any limit on the number, but due to the surge in applications, the number of plaintiffs was capped at 10,000. The recruitment target for the lawsuit group is citizens aged 19 or older, corresponding to the age of majority under civil law.
The first lawsuit, which claims 100,000 KRW in compensation from President Yoon, has already been filed with 105 plaintiffs participating. The 105 plaintiffs in the first lawsuit symbolically protested against the 105 People Power Party lawmakers who abstained from voting on the impeachment motion against President Yoon. The second lawsuit, which will include the remaining plaintiffs, plans to be filed soon with a reduced compensation claim of 10,000 KRW. The initial fees and attorney fees for this lawsuit are all free, and if victorious, all awarded damages will be donated to public interest organizations.
In the proposal, the lawsuit preparation group stated, "The declaration of emergency martial law and the interference with the National Assembly and its members' resolutions through martial law troops are not only unconstitutional but also constitute treason under criminal law, according to the majority of legal scholars and the judgment of most citizens." They added, "Each citizen of the Republic of Korea was deprived of their constitutional right to sovereignty and the right to form constitutional institutions based on the principle of representative democracy, and was threatened physically. The self-esteem enjoyed as citizens who fought for democracy and established a mature democratic nation and society was instantly shattered, and we had to endure humiliation from the international community."
They further emphasized, "Lawsuits claiming compensation against Yoon Seok-yeol (the President) should erupt like wildfire in all courts nationwide, holding him accountable under the Constitution, criminal law, and civil law." They raised their voices, saying, "Anyone who pointed a gun at the people must be utterly ruined so that no one in our constitutional history dares to attempt such unconstitutional acts again."
